Defamation of Character

A  cause of action that may arise from posting information on Facebook is where you have been  defamed. To prove defamation of character, the victim has to show that an untrue statement was published about him or her, it caused the victim injury and it was false and was not a privileged statement. 

You must use the copyright sign to protect things?
NO,  what you write or images you create are automatically protected with or without a C sign.
Years ago, copyright law required certain actions in order to enjoy copyright protection: publication, for example, or affixing a copyright symbol to the work. But no longer.

There are no issues in forwarding a persons email?
Sadly not, there are serious issues if you forward a persons email, espicially  if they have not given you permission to do so. Emails are private data and should not be divulged without specific permission to do so.

The Data Protection Act controls how your personal information is used by organisations, businesses or the government.

Everyone responsible for using data has to follow strict rules called ‘data protection principles’. They must make sure the information is:

  • used fairly and lawfully
  • used for limited, specifically stated purposes
  • used in a way that is adequate, relevant and not excessive
  • accurate
  • kept for no longer than is absolutely necessary
  • handled according to people’s data protection rights
  • kept safe and secure
  • not transferred outside the UK without adequate protection

There is stronger legal protection for more sensitive information, such as:

  • ethnic background
  • political opinions
  • religious beliefs
  • health
  • sexual health
  • criminal records

Third party designers

We understand that a third-party designer, former employee, or other staff may have been contracted to design and develop your company’s website, however, if no licence exists for the use of the image or images, the liability for any of copyright abuse lies with you (the company or the end user).

Unless you have the proper authority to use an image it may well be protected.
And in most cases they are.
